This legal notice includes the general conditions governing access to and use of the portal www.ponttibetacanillo.com, hereinafter “the Portal”, owned by the Municipality of Canillo (Comú de Canillo), with NRT D-061550-U, located in “Plaça Carlemany de Canillo, AD100”. Access to the Portal is free and viewing it does not require any prior registration or subscription. The Portal provides information on the Tibetan Bridge Canillo and the Roc del Quer Viewpoint.
Responsibilities
The Municipality of Canillo is not responsible for any damages caused or that may occur, of any nature, that derive from the use of the information, the content of the Portal and the programs that it incorporates, and that could cause, including but not limited to: errors or omissions in the contents, lack of availability of the Portal or the transmission of viruses or malicious or harmful programs in the contents, despite having adopted all the necessary technological measures to avoid it.
The information contained in the Portal is valid on the date of the last update, and the Municipality of Canillo does not guarantee the absence of errors in the access to the Portal or in the content, but will take the pertinent measures to avoid them, correct or update them as soon as they are detected. The Municipality of Canillo reserves the right to modify and update the information on the Portal, its presentation and configuration and access conditions without prior notice and at any time. Likewise, the Municipality of Canillo reserves the right to modify or omit totally or partially the contents of the Portal and restrict access to it. In the event that maintenance, repair, updating or improvement of the services must be carried out, the Municipality of Canillo reserves the right to temporarily suspend, without prior notice, access to the Portal, as well as the right to provision or cancellation of the services, without prejudice to trying to inform users, whenever circumstances allow. The use of this Portal and the information provided is the responsibility of the user. No third party may establish a framing relationship between its web pages and the Portal. Likewise, the Municipality of Canillo is not responsible for the content of third parties that can be accessed through the links contained in the Portal.
The user is responsible for compliance with the laws and regulations in force and the rules applicable to the use made of the products and applications. However, the use of the Portal contrary to good faith is prohibited, in particular and in a non-exhaustive manner: its use contrary to Andorran regulations or which infringes the rights of third parties; the publication or transmission of any content that is violent, obscene, abusive, illegal, racial, xenophobic or defamatory; alter or intervene by fraudulent means personal web pages, emails or systems of other users or third parties without their permission; cracks, programs serial numbers, or any other content that infringes on the intellectual property rights of others; the collection or use of personal data of other users without their express consent or in contravention of the provisions of qualified Act 29/2021, of 28 October, on Personal Data Protection; the use of the mail server, domain and e-mail addresses for the purpose of spam, mail bombing, impersonation, fraud in the custody of third parties, Scam 419, pharming, spreading viruses (Trojans, etc.) or any other type of activity carried out with fraudulent or criminal intent. It is expressly forbidden to access, modify, view the configuration, structure and files of the Portal servers. In the event of any problem that may occur to the servers and security systems of the Portal as a direct consequence of negligent action by the user, he will be liable for the corresponding civil and criminal liability. The user will respect the technical standards set by the Portal in the administration and development of the products used so that there is no misuse that delays the servers and harms the provision of products or rights of other users.
Intellectual Property on the contents
All the elements that appear on the Portal, without limitation (photographs, music, sounds, animations, software, texts, domain name, brands, information and content collected from all over the web, etc.), as well as the structure, graphic design and the source code, are the property of the Municipality of Canillo or, as the case may be, of third parties who have assigned the corresponding rights of use, and which the user of this website must respect, and who are therefore protected by intellectual property regulations.
Total or partial acts of reproduction, publication, computer processing, distribution, dissemination, transformation, compilation, modification, distribution or public communication of the Portal may not be carried out without the prior written consent of the Municipality of Canillo.
The access of the user to the contents and services of the Portal does not imply any right with regard to its transmission, transfer, use, alteration, exploitation, reproduction, distribution or public communication, object of intellectual property, without the prior express authorization granted specifically for this purpose by the Municipality of Canillo or the third-party holder of the rights, as the case may be.
Users of the Portal may only make private and personal use of its contents, i.e., they will only have the right to view and make copies of the contents for their personal and exclusive use and must apply these rights on the basis of the principles of good faith and current regulations. It is strictly forbidden to use the Portal or any of its elements for commercial or illegal purposes.
The unauthorized use of the information contained in this Portal, as well as the damages caused to the intellectual property rights, may give rise to the exercise of the pertinent legal actions and, where applicable, to the responsibilities derived from this exercise.
Commitments
The Municipality of Canillo undertakes not to make misleading advertising. In this sense, the formal or numerical errors that may be found in the content of the different sections of the Portal due to the incomplete or defective maintenance or updating of the information contained in these sections of the Portal will not be considered misleading advertising. As a result of what is mentioned in this section, the Municipality of Canillo undertakes to correct this situation as soon as it is aware of the errors indicated.
Acceptance
Use of the Portal implies the express and full acceptance of these general conditions and of each one of the provisions included in this legal notice in the version published at the time the user accesses this notice.
Accordingly, it is recommended that the user read this legal notice each time he accesses the Portal, as changes may be made to the general conditions, without prejudice to the particular conditions that may apply to certain specific services of the Portal.
These conditions of access and use are subject to Andorran law and the exclusive jurisdiction of the Andorran courts.
